TERMS OF SERVICE FOR MEETLIFY MOBILE APP (VER. 1.0, 31.03.2022)

I. General provisions
Definitions of terms used in the regulations:Regulations - Regulations for the provision of electronic services using the MEETLIFY mobile applicationService - a service provided electronically by MEETLIFY, in particular using a mobile applicationMEETLIFY or Service Provider - an entity providing electronic services: MEETLIFY SP. Z O.O., Aleksandra Lubomirskiego 27/1, 31-509 Kraków, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for Krakow - Śródmieście in Krakow, XI Department of the National Court Register under KRS number 0000768770, NIP: 6751694288, REGON: 382425232, phone no.: +48730705498, e-mail: office@meetlify.comCustomer or User - a natural person who is 18 years of age and has created an account in the ServiceAccount - a part of the System that allows the use of the System by logged in usersLicense - a non-exclusive license, free license granted to Customers to use the SystemProfile – profile created by the customer in the SystemRegistration - a multi-stage process consisting in setting up an account in the system. The activity is carried out by filling in the appropriate form in accordance with the given descriptions of the form fields, and then approving this form. During the registration process, the Customer will be able to log in to the System via personal accountLogin – a unique designation of the User created by the Administrator for the purpose of unambiguous identification to enable access to the ServicePassword – a string of letters, numbers and special characters randomly generated by the mobile application or the Administrator in order to secure the information provided by the UserAuthentication code – a unique string of digits sent to the user's email address provided during the registration processThese Terms of Service were issued on the basis of art. 8 of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2020 item 344 consolidated text) act of 30 May 2014 on consumer rights (Journal of Laws of 2020, item 287, of 2021, item 2105) of 27 July 2002 on special conditions of consumer sales and on the amendment of the Civil Code. (Journal of Laws No. 141, item 1176, as amended) and the Act of 23 April 1964 Civil Code (Journal of Laws of 2020, items 1740, 2320, of 2021, items 1509, 2459).

II. Types and scope of services provided
The service is aimed at consumers wishing to receive recommendations to get in touch with someone who is of value (business contest) in their immediate vicinity. The purpose of the service is to improve networking as part of business activities during fairs, congresses and conferences presence.The service enables Users to:view profiles of recommended usersedit the data contained in your profile,send invitations to other usersreceive invitations from other userslocate the approximate position of the user with whom the user has a confirmed meeting navigation to other usersturn off and on the visibility of your location in the "Do Not Disturb" modeUsing the Service to the extent specified in paragraph 2 is possible only for logged in Users after accepting these Terms of Use as part of creating a User profile

III. Terms of Service
MEETLIFY provides services to the Customer to the extent and under the conditions set out in these Terms of Use. MEETLIFY reserves the right to carry out maintenance works of the MEETLIFY system, which may cause difficulties or prevent the Customers from using the services. The dates of the work and the expected duration thereof shall be published, as far as possible, on the website of the meetlify.com before the commencement of the work.In specific cases affecting the security or stability of the electronic system, MEETLIFY shall have the right to temporarily cease or limit the provision of services without prior notice and to carry out maintenance work aimed at restoring the security and stability of the electronic system.MEETLIFY shall provide information via the meetlify.com or Customer e-mail about changes in the manner and scope of providing services by MEETLIFY and about the specific risks associated with the use of the service provided electronically.The User of the Service must download the mobile application to his personal device.After downloading and installing the mobile application, the User must set up a user account in order to use the Service. In the event of prior registration the User may log in using personal password and login of the Service.As part of the registration and creation of an Account, the User is required to provide the following data:first name and last namecompany nameunique catch phrasefrom to 3 to 7 Interests (in the form of keywords)personal photo (made with the device or uploaded from the gallery)Until the registration is completed by pressing the "next" button, it can be interrupted at any time. The user can change or delete individual data or close the application at any time. After completing the registration process, the User may change the data at any time.After receiving the offer from the User regarding the conclusion of the contract for the provision of the Service, the MEETLIFY will send the User appropriate confirmations and a verification code to the e-mail address provided during registration. By sending the said confirmation, you also accept the offer to conclude a contract for the provision of the Service. The User may start using the Service after completing the registration process.Any data provided by the User cannot be assigned to another person. It is also forbidden to provide false data, in particular those not belonging to the Users. It is the User's obligation to store his access data in a safe manner that prevents third parties from accessing the account.

IV. Technical requirements of the Service, security of service provision
The use of the Service requires the User to download a mobile application, respectively for the operating systems of mobile devices.The use of the Service requires in particular:the end device that supports BLE (and/or UWB) technologyan active e-mail account

V. Conditions for terminating the contract
The User has the right to terminate the use of the Service at any time and without giving reasons by activating the "Delete User Account" function in the mobile application.MEETLIFY may terminate the provision of the Service within 14 days, for important reasons, in particular:using the Service in a manner inconsistent with the lawusing the Service in a manner inconsistent with its purposeproviding false data of the User necessary to set up an Account

VI. Liability of the Service Provider
The Service Provider is obliged to provide the Service with due diligence and is responsible for its improper performance.MEETLIFY shall not be liable:for interruptions in the provision of services resulting from force majeure.for the inability to access services resulting from incorrect registration of the Customer

VIII. Complaint procedure  
The complaint must be in writing, under penalty of nullity, by e-mail to the following address: office@meetlify.comA complaint regarding non-performance or improper performance of the contract must contain, in particular, its subject matter and circumstances justifying it.In the complaint, the User should provide at least: his name and surname, correspondence address (it may be an e-mail address, if the User chooses this method of communication), the type and date of occurrence of the reasons for the complaint and all circumstances justifying the submission of the complaint. If the content of the complaint does not contain data that would allow for proper consideration of the complaint, MEETLIFY may ask the person submitting the complaint to supplement the data.MEETLIFY shall consider the complaint within 14 days from the date of its receipt. If the complaint cannot be considered within this time, MEETLIFY shall notify the complainant in writing of the reasons for the delay and the expected date of consideration of the complaint. Written information on how to consider the complaint will be sent to the e-mail address.  Lack of information about the consideration of the complaint in the indicated in the paragraph. 3 deadline will be considered as a positive consideration of the complaint.

IX. Protection of the User's personal data (Information on the processing of personal data)
The data controller of the user's personal data is MEETLIFY.The customer is obliged to update his personal data, in particular used in his Profile.Personal data are processed for the purpose of provision of electronic services by MEETLIFY.MEETLIFY does not intend to transfer data to a third-party partners.Personal data will be processed for the duration of the provision of services, and also for the time necessary to pursue claims or consider complaints related to services and for the time resulting from the provisions of generally applicable law.The User has the right to request MEETLIFY to access their personal data, rectify them, delete or limit processing, object to the processing of such data, transfer data under the conditions resulting from the law and agreed with the data controller, withdraw previously expressed consent to the processing of personal data, lodge a complaint to the supervisory body, which is the President of the Office for Personal Data Protection.  in matters of exercising your rights, you can contact MEETLIFY at the address indicated in paragraph 1 above.Personal data are processed on the basis of Article 6(1)(a)-(c) of the General Data Protection Regulation. Personal data is also processed on the basis of Art. 6 para. 1 lit. f in order to implement the legitimate interest of MEETLIFY consisting in the possible establishment or pursuit of claims or defense against claims.Providing data is required to provide services by electronic means. Failure to provide personal data will prevent MEETLIFY from concluding and performing a contract for the provision of these services.MEETLIFY does not make a decision that is based solely on automated processing of personal data. It also does not use automated processing of personal data, which consists in the use of personal data to assess certain personal factors of a natural person.MEETLIFY collects the following types of data in the purpose of:Contact Info – users’ name, company name, tags of interests and catch phrases to analyze the similarity of profiles and recommend valuable ones to users, to authenticate the User and personalize the User’s experience within app and to provide full app functionality and analyticsLocation data – to recommend value profiles within the BLE range and enable directional navigation between users within the UWB rangeDiagnostics to analyze data to evaluate user behavior, including to understand the effectiveness of existing product features, plan new features, or measure audience size or characteristicsIdentifiers and others data types to authenticate the user, enable/disable features, implement security measures, minimize app crashes, improve scalability and performance and perform customer supportData collected from an app is linked to the user’s identity and use only by MEETLIFY unless “DO NOT DISTURB” privacy protection mode is put in place before collection it.

X. Copyright
The use of the Application by the Customer or Users and other persons does not mean that they acquire any rights on intangible property to the works made available.It is forbidden to copy, modify or distribute the Application in whole or in part, as well as to modify or use it in a manner other than specified in the Regulations without the written consent of the Service Provider

XI. Final provisions
The Terms of Service may change in the event of:changes to the applicable legal provisions applicable to the Servicechanges to the functionality of the Service, with the proviso that the changes to the Terms are aimed at adapting the content of the Terms to its functionalitychanges in the activities carried out by MEETLIFY through the Service, in particular, in the event of the introduction of new services provided through the Service.In matters not covered by these Regulations, the provisions of the Civil Code, copyright law and the Act on the provision of electronic services shall apply.The Terms of Service shall enter into force on the day of their publication on the website of the meetlify.com.Amendments to the Terms of Service enter into force on the day of publication.
